Streszczenie:
Przedmiotem rozważań w referacie jest problematyka wykorzystania ryzyka regulacyjnego w procesie oceny programu „Mieszkanie dla Młodych” (MdM), który został uruchomiony na podstawie Ustawy przyjętej 27 września 2013 i będzie realizowany w latach 2014–2018. Pojęcie ryzyka regulacyjnego i jego rola nawiązuje do koncepcji prac projektowych i wdrożeniowych określanej jako Risk-based Regulation. Koncepcja ta jest rozwijana i analizowana przez takich ekonomistów, jak: B. Hutter (2005), R. Baldwin i J. Black (2007) oraz J. Black (2010b). Istota tej koncepcji wyraża się m.in. w tym, że zagadnienia zarządzania ryzykiem dominują nad znaczeniem zasad, jakimi kierować się należy w implementacji regulacji. Struktura referatu przedstawia najpierw krytyczną ocenę programu „MdM”, następnie definiuje ryzyko regulacyjne i oświetla jego rolę w programie „MdM”. Najważniejsza część rozważań poświęcona jest kwestiom pomiaru ryzyka. Analizuje się trzy podejścia do pomiaru ryzyka (iloczyn prawdopodobieństwa i skali skutków zdarzeń negatywnych), które umownie nazwano: celowe, procesowe i podmiotowe. Z referatu wynika, że praktyka pomijania ryzyka regulacyjnego w pracach legislacyjnych zdecydowanie wpływa na obniżanie jego efektywności i destrukcję jakości prac rządu.

THE PROBLEM OF REGULATORY RISK. THE CASE STUDY OF THE GOVERNMENTAL PROGRAM „APARTMENT FOR YOUNG”
Abstract:
The topic of discussion in this paper is the issue of the implementation of regulatory risk in the evaluation of the governmental program “Apartment for Young” (Polish abbreviation MdM), which was launched in 2014 under the Act, adopted by Parliament on 23rd September 2013. It will be implemented in the years 2014–2018. The regulatory risk relates to the idea described in literature as a “Risk – based Regulation”. This concept is developed and analyzed by economists such as: B. Hutter (2005), R. Baldwin & J. Black (2007) and J. Black ( 2010). The essence of it shows how important are principles related to the risk management in the legislation procedure and the implementation of regulations. The structure of the paper presents the critical assessment of the “MdM”, then defines the regulatory risk. The most important part of the discussion is devoted to issues of risk measurement. It analyzes three approaches to risk measurement (the combination of the likelihood and the scale of the potential, negative impact) which are categorized as: intentional, process and entitative oriented. The paper shows that the practice of omitting regulatory risk in the legislative procedure strongly influences the reduction of efficiency and quality of regulations and destroying governmental works.
